General terms and conditions and mandatory legal information
1 Scope / Identity of the provider
These general terms and conditions apply to all contracts that you conclude with us, DRIVER13, Matthias Schempf, Herrenalber Str. 48, 75334 Straubenhardt, email: mail@driver13.de, phone: +49708260422, via our online shop at https://driver13.de.
2 Definitions / Applicable law
2.1 A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to his or her commercial nor his or her independent professional activity.
2.2 An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
2.3 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in a member state of the European Union, this choice of law does not apply to the extent that it deviates from mandatory provisions of the state of your habitual residence, from which no deviation may be made by agreement.
3 Contract language / storage of the contract text
3.1 The contract language is German.
3.2 When ordering via the shopping cart function of our online shop, you can print or electronically save the complete contract terms (order data, general terms and conditions and cancellation policy) using the browser's print function before completing the order. They will be sent to you again by email with the confirmation of receipt of your order. In addition, the contract text will be saved by us in compliance with data protection regulations and will be available for you to access even after the order has been completed.
3.3 If you send us enquiries regarding the conclusion of a contract via other contact options provided on our online shop (e.g. by email), you will receive the complete contractual provisions by email so that you can print them out and save them electronically.
4 Conclusion of the contract / correction of input errors
4.1 The offers published by us represent binding offers to conclude a contract.
4.2 You can place a binding order for the goods offered in our online shop using the "shopping cart function". To do this, place the desired item in the shopping cart using the corresponding button in the respective offer. This allows you to place several items in the shopping cart one after the other. You can access your shopping cart using the corresponding button in the navigation bar. You can make any changes you want there or start the ordering process using the "Proceed to checkout" button.
Then enter your shipping details and select the payment method you want. You can check your selections and entries at any time using the "Back" function on your browser and correct any input errors or cancel the order process by closing the browser window. In addition, all selections and entries are displayed again on the order overview page and can also be changed and corrected there using the corresponding buttons.
By submitting your order via the "order with payment" button, you declare your binding acceptance of our offer, whereby the contract is concluded.
4.3 Requests to conclude a contract that you send to us via other contact options provided on our online shop (e.g. by email) are non-binding for you. We will then make you a binding offer, which you can accept within one week, unless otherwise stated in the offer.
5 Prices and payment terms
5.1 The prices stated in our offers are total prices and include statutory VAT.
5.2 Any shipping costs that may be incurred are not included in the total price stated. Whether additional shipping costs are incurred and their amount can be viewed via a correspondingly labelled button on our website and, if applicable, on the respective item page. If additional shipping costs are incurred, these will also be shown separately during the ordering process.
5.3 For deliveries to countries outside the European Union, additional costs (e.g. taxes, customs duties) may arise, which must be borne by you and paid directly to the relevant authority.
5.4 The payment methods listed below are available to you for payment under the conditions specified therein:
PayPal: You can pay by credit card, debit card, prepaid card, invoice or SEPA direct debit via the payment service provider PayPal (PayPal Europe S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg). PayPal's terms of use apply here, which can be found at: https://www.paypal.com/de/webapps/mpp/ua/legalhub-full. To use PayPal's payment services, you may need your own PayPal account. Payment by invoice also requires a prior positive credit check. To carry out payment by invoice, we assign our claim against you to PayPal. You then pay the invoice amount to PayPal immediately after receiving the invoice within the agreed payment period. If you use the SEPA direct debit procedure, PayPal will inform you by email before your account is debited. Otherwise, your account will be debited immediately when the payment is made.
Klarna invoice: You can make payment by invoice via the payment service provider Klarna (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm). Klarna's terms of use apply here, which can be found at: https://www.klarna.com/de/agb/. To use the Klarna invoice payment method, you need your own Klarna account. Payment also requires a prior positive credit check. To carry out the payment, we assign our claim against you to Klarna. You then pay the invoice amount directly to Klarna after receiving the goods from us within the agreed payment period.
Credit/debit card: When paying with a credit or debit card, the transaction is carried out immediately after the contract is concluded and your account is debited.
Apple Pay: With the Apple Pay function, you can make payments via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA, using a credit, debit or prepaid card. To do this, you need a device that has been activated with the Apple Pay function and you must use it to visit our website via the Safari browser. After selecting your payment method and providing the appropriate identification and confirmation of the payment, your account will be charged immediately when the transaction is carried out.
Google Pay: With the Google Pay function, you can make payments via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland, by credit or debit card or PayPal. You will need your own Google account for this. After selecting your payment method, providing appropriate identification and confirming the payment, your account will be debited immediately when the transaction is carried out, unless otherwise specified in the terms of use of the selected payment method (e.g. SEPA direct debit via PayPal).
Amazon Pay: When paying via Amazon Pay, the payment is processed via Amazon by Amazon Payments Europe sca, 38 avenue John F. Kennedy, L-1855 Luxembourg. Their terms of use apply, available at: https://pay.amazon.de/help/201751590. To pay via Amazon Pay, you need your own Amazon account. The payment methods you set up and stored there are available to process the payment. Your account will be debited according to the payment terms agreed with Amazon for the respective payment method stored, available at: https://www.amazon.de/gp/help/customer/display.html?ref_=hp_left_v4_sib&nodeId=GFBWMNXEPYVJAY9A.
5.5 Unless otherwise provided above, the payment claims against you arising from the concluded contract are due for payment immediately.
6 Delivery conditions
You can view the delivery conditions applicable to the respective offer (delivery types, applicable delivery costs and delivery date) via a corresponding button on our website or on the article page of the offer.
7 Warranty rights
Your warranty rights in the event of defects are governed by the statutory provisions.
8 OS platform / place of jurisdiction
8.1 The European Union provides an online platform for the out-of-court settlement of disputes (ODR platform) at: https://ec.europa.eu/odr.
8.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from and in connection with the contract concluded with us is our registered office. The same applies if you do not have a general place of jurisdiction in a member state of the European Union or, in the event of legal action against you, your place of residence or habitual abode is not known at the time the action is brought.
